Revel Rental Mopeds Now in Miami

The list of locations, aside from Miami, that Revel rents mopeds in includes Queens and Brooklyn in New York; Oakland California; Austin Texas; and Washington DC. The mopeds provided by Revel are made by NIU Technologies which is based in China.

In Miami, Revel has interesting boundaries for the service area. The neighborhoods within the boundaries include:

  • Wynwood
  • Overtown
  • Model City
  • Liberty City
  • Little Havana
  • Little Haiti
  • Edgewater
  • Downtown Miami
  • Coral Way

However, Miami Beach is excluded from Revel’s service area. In addition, Revel renters are prohibited from driving the mopeds on highways and crossing major bridges. Use of the moped outside the areas of service could be deemed a failure to comply with the terms and conditions of the Revel agreement and void any possible insurance coverage.

Is There Moped Insurance for Miami Revel Moped Accidents?

If you are injured in a Revel moped accident, is there insurance available to pay your medical bills, lost wages and your pain and suffering? The answer is maybe.

First, there is the question of whether the moped driver complied with all the rules, regulations and policies of Revel. This becomes especially relevant when the issues of insurance coverage arise after a Revel moped accident in Miami. It is likely if there is a violation, then Revel will rely on that to deny any claim.

Second, initially it appeared that it would be unlikely that Revel would provide any insurance coverage for anyone’s injuries and damages.  The reason is hidden in the “Updated Revel Rental Agreement Waiver of Liability and Release” which our attorneys obtained and reviewed. Specifically, at Section 4.0 entitled “Damages; Liability Coverage” on page 11, Revel’s Rental Agreement states: “Revel provides third party auto liability coverage that meets the statutory financial requirements in each jurisdiction of operation for damages during a Member’s use of Mopeds…” In Florida, there are no insurance requirements for mopeds. In addition, liability insurance is not required for vehicles. As such, under the Agreement, Revel did not appear to be required to provide any liability insurance for moped drivers in Florida.

After further inquiry, our Miami car accident lawyers were able to confirm with Revel that in Florida the company will actually provide bodily insurance coverage for Revel drivers. They will provide limits of $25,000 per person and $50,000 per accident in addition to $10,000 for property damage caused by the Revel driver. Revel is now in the process of updating their links to include insurance coverages for all of their markets. Here is the breakdown for each of Revel’s markets:

  • California:
    • Bodily injury:$25,000 per person and $50,000 per accident
    • Property damage:$10,000 property damage
  • Florida:
    • Bodily injury:$25,000 per person and $50,000 per accident
    • Property damage:$10,000 property damage
  • New York:
    • Bodily injury:$25,000 per person and $50,000 per accident
    • Property damage:$10,000 property damage
  • Texas:
    • Bodily injury:$30,000 per person and $60,000 per accident
    • Property damage:$25,000 property damage
  • Washington D.C.:
    • Bodily injury:$100,000 per person and $300,000 per accident
    • Property damage:$50,000 property damage

The Rental Agreement does provide that the moped driver’s personal auto insurance will be primary. That means the first avenue of recovery is going to be the moped driver’s insurance if he or she has any. However. there is no guarantee that the driver’s insurance will honor any claims arising out of the use of a rental moped. If the personal auto insurance policy of the renter declines coverage, then an injured party would proceed against the Revel insurance policy.

In short, if you or a loved one were injured in a Revel moped accident due to the moped driver’s negligence you can pursue a claim against the  renter in Florida. At a minimum, there should be $25,000 in insurance coverage for the negligent Revel operator to compensate you for your damage including medical expenses, loss of earnings and pain and suffering. There may be additional avenues of recovery depending on the facts of your accident, but you should call the Miami Revel moped accident attorneys at Wolfson & Leon at (305) 285-1115.
